Terms and Conditions of Service
Rodley Plastering (Lishman’s Properties Limited)

These Terms and Conditions (“Agreement”) are entered into between [Company Name], hereinafter referred to as “the Company,” and the client (“Client”) for the provision of plastering services (“Services”). By accepting the Company’s offer or engaging the Company’s services, the Client agrees to abide by the terms set forth in this Agreement.
1. Scope of Services
The Company will provide plastering services as detailed in the quotation provided to the Client. This may include, but is not limited to, skimming, plasterboarding, rendering, and other related plastering services.
2. Payment Terms
a) Due on Completion: Payment for Services is due in full upon completion of the work, unless otherwise agreed upon in writing.
b) Accepted Payment Methods: Payments will be accepted via cash or bank transfer.
c) Late Payments: Any payment not made within 5 days of completion will be subject to a late fee of 10% per day. The Company reserves the right to suspend or withhold further services until payment is made in full.
d) Refunds: No refunds will be issued unless the work is found to be defective or not performed according to agreed-upon specifications.
3. Client’s Responsibilities
a) Access to Property: The Client is responsible for providing safe, clear, and adequate access to the property for the Company’s personnel and materials.
b) Preparation: The Client agrees to ensure that the area to be plastered is prepared properly, including the removal of furniture, fixtures, and any obstructions.
c) Approval: The Client must review and approve the scope of work, specifications, and any changes before work begins.
d) Utilities: The Client agrees to provide necessary utilities water, electricity, etc. to facilitate the work.
4. Company’s Responsibilities
a) Completion of Work: The Company will carry out the plastering services with due skill, care, and professionalism, as per the agreed-upon scope.
b) Workmanship: The Company guarantees that all plastering work will be free of defects in workmanship for 6 months from the completion date.
c) Clean-Up: The Company will remove debris and clean up the work area as best as possible upon completion of the Services.
5. Warranty
a) Limited Warranty: The Company provides a limited warranty on the quality of workmanship for 6 months from the date of completion. This warranty is contingent upon the Client adhering to proper care and maintenance instructions.
b) Exclusions: The warranty does not cover damage caused by external factors such as accidents, negligence, misuse, or changes in environmental conditions.
6. Liability and Limitation of Liability
a) No Liability for Loss or Damage: The Company shall not be responsible for any loss or damage to property, personal injury, or accidents, except where caused by the Company’s negligence or failure to perform services in accordance with this Agreement.
b) Indemnity: The Client agrees to indemnify and hold harmless the Company, its employees, and subcontractors against any claims, damages, or losses arising from the Client’s failure to fulfill their responsibilities under this Agreement.
c) Insurance: The Company maintains public liability insurance for its work, but the Client is responsible for obtaining any additional insurance they feel is necessary.
7. Cancellation and Termination
a) Cancellation by Client: The Client may cancel or reschedule the work by providing 7 Days notice before the scheduled start date. If the Client fails to do so, a cancellation fee of £50 may apply.
b) Cancellation by Company: The Company reserves the right to cancel the contract or terminate the Services if the Client fails to make payment, fails to provide necessary access, or violates any of the terms of this Agreement. In such cases, the Client will be liable for the costs incurred up to the point of cancellation.
8. Disputes and Governing Law
a) Dispute Resolution: In the event of any dispute or disagreement arising from this Agreement, the parties will attempt to resolve the matter amicably through negotiation. If a resolution cannot be reached, the dispute may be referred to mediation or arbitration.
b) Governing Law: This Agreement will be governed by the laws of England and Wales.
9. Force Majeure
Neither party will be held liable for failure to perform their obligations under this Agreement due to circumstances beyond their reasonable control, including but not limited to, acts of God, government regulations, fire, flood, or other unforeseen events.
10. Entire Agreement
This Agreement constitutes the entire understanding between the Company and the Client, superseding any prior oral or written agreements. Any amendments to this Agreement must be in writing and signed by both parties.
11. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

By accepting the Company’s services or providing approval for the work, the Client acknowledges and agrees to these Terms and Conditions.
